Trailer had no brake lights or even any mounted, would it still be considered his fault?

To me it looks like there are brake lights mounted. Looks like on the back wall, near the top, there are 2 round lights. Can't tell if they were working (camera angle),but he also may have let off the brakes as he made the turn.
